The BSIF is often asked what to do if employees are not using the PPE which has been issued to them. The health and safety legislation is quite clear on this. It is the employer's responsibility to ensure that employees wear their protective equipment and there is no mitigation for any contributory negligence. This is always a difficult situation since, if the employee refuses to use the PPE provided, the employers will be forced to institute disciplinary procedures with the potential outcome that recalcitrant employees are likely to be dismissed if they continue to jeopardise their own safety in this way.
